Effective 7:00 A.M. (CST) on the date(s) shown, Sunoco Marketing & Terminals will pay the following base prices per barrel (42 U.S. Gallons) for crude oil and condensate purchased and delivered for Sunoco Marketing & Terminals' account into Sunoco Marketing & Terminals' designated receiving agent. The posted prices Sunoco Marketing & Terminals will pay for crude oil and condensate will be determined after the application of all adjustments to the base price, including adjustments for API gravity and transportation. All crude oil and/or condensate purchased shall be of merchantable quality, that is, unaltered and uncontaminated by any foreign substances or chemicals not normally associated with such oil, and which is suitable for normal refinery processing. Applicable measurements, deductions, and adjustments for temperature, BS&W, and API gravity will be made in accordance with the rules and regulations of Sunoco Marketing & Terminals' receiving agents and the applicable regulatory body. All of the following base prices are subject to change without notice and are subject to the terms and conditions of the applicable Division Orders or other contracts. If applicable law or government regulations require adjustments to Sunoco Marketing & Terminals' posted prices or effective dates, Sunoco Marketing & Terminals reserves the right to amend these prices and recover any excess payments by withholding payments from future settlements or by separate invoicing. Sunoco Marketing & Terminals reserves the right to refuse crude oil or condensate having a Reid Vapor Pressure of 10 PSI or above.
